The petitioner seeks bail in a case instituted under Sections 341, 323, 386, 379, 504, 506, 353/34 of the Indian Penal Code.
The allegation against the petitioner is of abusing and assaulted the informant by means of knife due to which his hand was cut.
Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application, with observation "at this stage".
A report was called for from the trial court regarding the stage of the case. It has been reported that the
Patna High Court Cr.Misc. No.33955 of 2017 (3) dt.18-10-2017 2/2 charge has been framed in the present case.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.09.2016. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Due to political reason, the petitioner has been made accused in the present case. A complaint case was filed by the petitioner prior to the institution of the present case. Similarly situated other coaccused has been granted bail by the court below. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jhanjharpur, Madhubani, in connection with Phulparas P.S. Case No. 181 of 2016.
