The petitioner seeks bail in connection with Barachatti (Mohanpur) P.S. Case No. 12 of 2017 (POCSO Case No. 4 of 2017), registered under Section 376 of the Indian Penal Code and Section 4 of Prevention of Children from Sexual Offences Act.

The accusation is of committing rape upon the daughter of the informant by unknown boy belonging to Bhuinya community. It is alleged that victim claimed to identify the accused on seeing him again.

Learned counsel for the petitioner submits that petitioner and informant are co-villager and mere on suspicion, he has been apprehended by the Police, who got recorded the

Patna High Court Cr.Misc. No.24490 of 2017 (2) dt.30-06-2017 2/2 confessional statement of the petitioner showing his involvement in the present case. Further submission is that while victim claimed to identify the culprit on seeing him again, but till date petitioner, who is co-villager of the informant has not been put on T.I.P, while he is in custody since 15.01.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-I-cum-Special Judge (POCSO) Act, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 12 of 2017.
