Mr.Asha Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-05-2025 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

2. The petitioner is seeking regular bail in connection with Nawada P.S. Case No. 1279 of 2024 for the offences punishable under Sections 103(1)/3(5) of the BNS.

3. The dead body of the deceased was found in the house of co-accused Bichchi Devi, who was residing in a rented premises of Jamuna Choudhary. According to the FIR lodged by mother of the deceased, Jamuna Choudhary apprised the mother of the deceased that her son's dead body was present in the rented house occupied by co-accused Bichchi Devi. The body was recovered and co-accused Bichchi Devi, in her confessional statement, has stated that she developed physical relations with the deceased, but his marriage was fixed elsewhere. She further stated that she came into contact with the present petitioner and had illicit relations with him. 4. Learned counsel for the petitioner has submitted that that the petitioner is innocent and falsely been implicated in this case. He has further submitted that the informant is not an eye witness to the occurrence rather she raised suspicion against the petitioner because the son of the informant used to take liquor with the petitioner. The petitioner is under custody since 30.10.2024.

5. Learned APP for the State has opposed the prayer for bail.

6. The dead body was found in the house of coaccused Bichchi Devi and in her confessional statement, she stated that she, along with the present petitioner, had committed the murder of the deceased.

7. Considering the above-mentioned facts and circumstances as well as the gravity of the allegation, I do not think it to be a fit case for bail, which is hereby rejected. (Nawneet Kumar Pandey, J) Nirmal/- U T
