JUSTICE SANJAY PRIYA ORAL ORDER 27-07-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in Ahiyapur P.S. Case No. 425 of 2015 instituted for the offence under Sections-395 and 397 of the Indian Penal Code.
It is alleged in the written report that in the night of 20/21-5-2015, 20-25 unknown persons armed with gun, Danda etc. entered into house and looted the property ornaments worth Rs. 1,76,000.00 and also looted cash of the son of the informant amounting to more than lacs. The culprits were of age group 20-30 years and two of them about 50-60 years.
It has been submitted that the petitioners are not named in the first informant report. No TIP has been conducted. The
Patna High Court Cr.Misc. No.32061 of 2017 (3) dt.27-07-2017 name of the petitioners has been disclosed by co-accused Md. Irshad in his confessional statement, who has already been granted bail by coordinate bench of this court vide order dated 20-08-2015 passed in Cr. Misc. No. 34258 of 2015.
In such circumstances, prayer for bail is allowed. The petitioners named above are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ahiyapur P.S. Case No. 425 of 2015 to the satisfaction of Ms. Rani Kumari, learned Judicial Magistrate, Muzaffarpur subject to condition that both the bailors should be close relative of the petitioners.
