In this case, the petitioner is seeking regular bail in connection with K. Hat (Madhubani) P.S. Case No. 1222 of 2022, registered for the offences punishable under Sections 401, 411, 413, 414, 379 of the I.P.C.

The learned counsel for the petitioner has submitted that some accused persons were arrested on the allegation that they were engaged in dealing with stolen motorcycle. He has also submitted that the petitioner was not arrested at the spot. He is a person of clean antecedent and he is under custody since 09.11.2022. The arrested persons namely Mitthu Mukhiya, Ravindra Mahaldar, Ajay Kumar and Resham Rishi have been

Patna High Court CR. MISC. No.14443 of 2023(2) dt.19-05-2023 2/2 granted bail by the coordinate Benches of this Court in Cr. Misc No. 15642 of 2023 and Cr. Misc No. 12238 of 2023 respectively.

Considering the above-mentioned facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with K. Hat (Madhubani T.O.P) P.S. Case No. 1222 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
