The petitioner seeks regular bail in connection with Sadar P.S. Case No. 898 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code. The present FIR is against three named accused persons, however, the name of the petitioner does not find place in the present FIR. Nonetheless, it is the case of the informant that the said three FIR named accused persons had snatched the Scorpio vehicle of the informant on gun point. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case merely on the basis of the confessional statement made by the petitioner herein which is not admissible in the eyes of law. Parade so as to connect the petitioner with the alleged crime. Lastly, it is submitted that the petitioner has a clean antecedent and is languishing in custody since 27.11.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S. Case No. 898 of 2018.
