Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The FIR of the occurrence of murder is against unknown. Name of the petitioner has surfaced in the confessional statement of Munna Sah. Co-accused Appu Singh @ Sanjeev Singh has already been allowed bail by the learned court below and Munna Sah has been allowed bail by a Coordinate Bench of this Court vide order dated 14.11.2017 passed in Cr. Misc. No. 54039 of 2017 (Annexure-3).
Considering the aforesaid fact as well as the fact of completion of investigation, let the petitioner, above named, be
Patna High Court Cr.Misc. No.16371 of 2018 (2) dt.22-03-2018 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 35 of 2018 arising out of Kateya Police Station Case No. 82 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
