The petitioner apprehends his arrest in Complaint Case No. 1516(C) of 2012 registered under Sections 498(A), 323 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
The wife of the petitioner made allegations that the petitioner subjected her to physical and mental torture due to nonfulfillment of additional demand of dowry. Learned counsel for the petitioner submits that the petitioner is still ready to keep his wife. The marriage was solemnized in the year 2007.
Considering the fact that the petitioner is still ready to keep his wife, the petitioner is directed to surrender in the court
Patna High Court Cr.Misc. No.4925 of 2015 (2) dt.04-02-2015 2/2 below within four weeks from today and the court below shall grant provisional bail to the petitioner for two months in Complaint Case No. 1516(C) of 2012 on furnishing bonds in the sum of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Biharsharif, Nalanada. The court below shall also issue notice to the complainant and make all efforts for reconciliation of the dispute between the husband and the wife. If the dispute is resolved amicably between the parties, the provisional bail so granted to the petitioner shall be confirmed. In case the dispute is not resolved, the court below shall pass orders on the prayer for bail of the petitioner on its own merit.
