Petitioner, already in custody, seeks bail in connection with Bhagwanpur P.S. Case No.123 of 2014, registered under Sections 366(A), 120(B), 34 of the Indian Penal Code. Allegation in brief is that the petitioner enticed away the minor daughter of the informant, student of Class X. Learned counsel for the petitioner submits that the petitioner married with the daughter of the informant and the girl was major and she died by accidental burn injury while cooking meal at Mysore. Her dying declaration was also recorded but the case is still under investigation; whereas the learned counsel for the State submits that the girl is minor, she was a student of Class X and she died in suspicious

Patna High Court Cr.Misc. No.10900 of 2018(3) dt.04-04-2018 2/2 circumstance and the matter is still under investigation. Having considered the said facts and circumstances, the Court is not persuaded to admit the petitioner on bail, so the prayer of bail of the petitioner is rejected in connection with Bhagwanpur P.S. Case No.123 of 2014 pending in the court of learned ACJM-II, Siwan.

However, the trial court is directed to expedite the trial.
