JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 18-07-2023 Heard Mr. Bipin Bihari Singh, learned counsel along with Mr. Shyama Kant Singh, learned counsel appearing on behalf of the petitioner and Mr. Vivek Anand Amritesh, learned AC to SC-28 for the State.

2. The petitioner has filed the present writ petition for the following reliefs:

"That, the present writ petition is for issuance of appropriate writ/writs, direction/directions to authorities for consideration, adjudication, final decision and payment of in-service and post- service benefits after due calculation as represented by her repeatedly lastly on 17.11.2021 in terms of the observations and directions of Hon'ble Apex Court on 23.07.2013 in Special Leave to Appeal bearing No. 15950/2010 (Raj Nandani Kumari versus State of Bihar

Patna High Court CWJC No.3071 of 2023 dt.18-07-2023 2/2 and others) and further prayer for payment of interest on delayed payment at market rate with litigating cost for unnecessary harassment and for the other necessary relief/reliefs on the basis of the facts and circumstances of the case enumerated stated and discussed hereinafter."

3. Learned counsel appearing on behalf of the petitioner seeks to file representation before the District Education Officer, Khagaria for making payment of his retiral dues. The District Education Officer, Khagaria must ensure to obtain all the requisite records relating to the petitioner from respondent no.6 - The Secretary Savitri Girls Middle School, Khagaria and ensure that retiral dues on different heads must be paid to the petitioner by forwarding all the papers to the Accountant General, Bihar who will ensure fixation of pension to the petitioner. The above exercise must be done within a period of six weeks from the date of filing of the representation by the petitioner.

4. The writ application, accordingly, stands disposed of.
