The petitioners seek bail in connection with a case registered for the offence punishable u/s 363/34 of the IPC and later on section 302 IPC was added.

As per the prosecution case, the petitioner no.1 used to pressurize the informant to compromise a case filed by her against the petitioner no.1 and used to threaten her with dire consequences. It is stated that husband of the petitioner had gone to attend call of nature and did not return. Suspicion is raised by the informant that the petitioners have disappeared her husband.

It is submitted by learned counsel for the petitioners that

Patna High Court CR. MISC. No.16642 of 2024(3) dt.19-04-2024 2/2 petitioners are quite innocent and have not committed any offence as alleged in the FIR. Petitioners have been falsely implicated in this case due to enmity. Earlier the informant has filed a case against the petitioner no.1 u/s 379, 341, 323, 354(B), 504/34 of the IPC. There is general and omnibus allegation against the petitioners and there is no eye-witness to the alleged occurrence and only on suspicion, petitioners have been made accused in this case. Charge sheet has been submitted against the petitioners. Petitioner no.1 has one criminal antecedent and petitioner no.2 has no criminal antecedent and they are in custody since 23.12.2023.

Learned APP for the State opposed the prayer for bail. 6.

Considering the facts and circumstances of this case, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Sasaram (M) P.S. Case No.404/2023.
