The petitioner is accused in connection with Kadwa P.S. Case No. 27 of 2017, registered under Section 364/34 of the Indian Penal Code.
The accusation is that, on 05.02.2017, in the evening, Girija Devi, mother of the informant, had gone to Sonaili Bazar to purchase vegetable, where she met with Lakhi Devi, but the mother of the informant did not return to her house. Thereafter, informant started searching her but no trace was found and her both mobiles were found switched off.
Learned counsel for the petitioner submits that, in fact, petitioner is not named in the F.I.R. but in course of investigation
Patna High Court Cr.Misc. No.29955 of 2017 (3) dt.14-07-2017 it has come in paragraph 33 of the case diary that Girija Devi, used to sell the clothes roaming in the village and at that time, she was apprehended and this petitioner provided the money for her release except that there is nothing against the petitioner showing her involvement in the present case. Further submission is that petitioner is in custody since 24.02.2017.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Katihar, in connection with Kadwa P.S. Case No. 27 of 2017. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
