Case No. 9 of 2017 registered for the offence(s) under section(s) 25 (1-b), 26 of the Arms Act.

Allegation against the petitioner is that of recovery of two pistols and cartridges from his possession. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and the Police planted two country made pistols showing that it has been recovered from the possession of the petitioner. It has further been submitted that as a matter of fact, FIR has been lodged in connection with this case at 9:00 P.M. and immediately the petitioner has been arrested at 9:15 P.M. from his house. Heard learned Additional Public Prosecutor also. Learned Additional Public Prosecutor opposes the prayer of bail. Having heard both sides and in view of the allegation made in the FIR, I am not inclined to grant bail to the petitioner at this stage. Accordingly, this application is dismissed. However, the petitioner may renew his prayer for bail after framing of charge in this case.
