JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Riga P.S. Case No. 19 of 2014 for the offences instituted under Sections 341 and 307/34 of the IPC. Later on, Section 302 IPC was also added.

The prosecution story, in brief, is that on the alleged date and time of occurrence, the informant told to her daughter, namely, Ruby Khatoon, to sleep after taking meal. In the meantime, at the verandah of the house, the petitioner and other accused persons surrounded the daughter of the informant carrying kerosene oil. It is further alleged that petitioner sprinkled kerosene oil over the body of daughter of the informant and co-accused Kalam Mansoor set the daughter of the informant on fire by match

Patna High Court Cr.Misc. No.11223 of 2016 (2) dt.25-04-2016 2/2 stick. Thereafter they fled away. The informant took her daughter to hospital with help of the villagers for treatment. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. Earlier the case was instituted for the offences registered under Sections 341 and 307/34 of the IPC. Later on, Section 302 IPC was also added. There is admitted family dispute between the parties. The police had submitted final form against the petitioner and the same was accepted by the court. Later on, the revisional court had remitted the matter back to the court below.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Riga P.S. Case No. 19/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. .
