Petitioner seeks bail in connection with Pandaul P.S. Case No. 233 of 2016 registered under Sections- 272, 273 of the Indian Penal Code and sections 30(i)/36/38 of the Excise Act.

Learned counsel for the petitioner submits that petitioner has no concern with the seized wine. Petitioner lives separately from co-accused Arjun Paswan. Mukhiya and Sarpach are witnesses of the seizure list who became in inimical terms with the petitioner on account of Panchayat elections. Petitioner has no criminal antecedent and is in custody since 23.12.2016.

Patna High Court Cr.Misc. No.25570 of 2017 (3) dt.30-06-2017 Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S. Case No. 233 of 2016.
