JUSTICE ARVIND SRIVASTAVA ORAL ORDER 07-03-2018 Heard learned counsels for the petitioner and the State. Petitioner seeks bail in connection with Waina P.S. Case No. 63 of 2016 registered for the offence punishable under sections 302/34 of the Indian Penal Code.

Petitioner has earlier moved this Court for grant of bail in Cr. Misc. No. 3330 of 2017, which was rejected vide order dated 20.03.2017 (Annexure-1).

Learned counsel appearing for the petitioner submits that petitioner is languishing in custody since 14.06.2016. The case was committed to the Court of Sessions on 16.08.2016, however there is hardly any progress in the trial.

A report was called for from the Court below vide order dated 17.01.2018, which has been received and is kept at FlagX. Perusal of the same shows that charges have been framed in

Patna High Court Cr.Misc. No.3382 of 2018(3) dt.07-03-2018 2/2 this case on 09.09.2016 and thereafter four witnesses have been examined.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find any fresh ground to reconsider the prayer for bail of the petitioner. It is, accordingly, rejected.

However, considering the period of detention of the petitioner in custody, the trial Court is directed to expedite the trial of the case and conclude it expeditiously, preferably, within a period of six months from today.
