The accused/petitioner is named in the F.I.R. and apprehended his arrest in connection with Shekhopur Sarai P.S. Case No.136 of 2022 registered for the offences punishable under Sections 419, 420, 467, 468, 471, 406 and 120-B/34 of the Indian Penal Code.
As per narration of the F.I.R. it appears that informant, who is S.H.O. Shekhopur Sarai, while on round of the area found accused petitioners with 33 others named co-accused persons sitting together having in possession of several mobile
Patna High Court CR. MISC. No.14987 of 2023(2) dt.25-05-2023 2/3 phones and passport belongs to others, where it has been suspected that they had cheated certain unknown persons. Learned counsel appearing on behalf of the petitioner submitted that petitioner has been falsely implicated in this case, where narration of F.I.R. is not suggesting any offence. It is suggesting that mere on the basis of suspicion that certain documents were found in possession of co-accused persons including petitioner, the present false case was lodged. While concluding the argument it is submitted that petitioner is a man of clean antecedent.
Learned APP appearing on behalf of the State, opposes the prayer for bail.
In view of the facts and circumstances as mentioned above and by taking note of the fact as only on the basis of suspicion, petitioner appears to be implicated, prima facie, with this case, accordingly the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura/concerned Court below where the case is pending in connection with
