JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 364,302,379,201 and 120B of the Indian Penal Code. It is alleged that the petitioners under criminal conspiracy, took the son of informant's daughter to their house and subsequently the dead body of the victim was recovered. The case diary was called for vide order dated 2.8.2014. The learned A.P.P. after going through the case diary submits that only three witnesses have been examined so far during investigation. No.20754 of 2014 (5) dt.13-03-2015 2/2 statement of the informant, paragraph 5 contains statement of Amit and paragraph 6 contains the statement of one Shailendra whereas paragraph 25 contains the supervision note of Dy. S.P. but none of the witnesses averred anything on the factum of taking away of the victim. The investigation is pending. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Banka in connection with Banka P.S. Case No. 1 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
