Petitioner seeks bail in connection with Sasaram (Darigaon) P.S. Case No. 74/17 for offences punishable under Section 366 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that his daughter Chinta Kumari aged 20 years has illicit relationship with the petitioner and has eloped with him. It has been submitted by the learned counsel for the petitioner that the victim girl is a major and there was love affair between the petitioner and Chinta Kumari and later on when the victim girl was recovered she has stated in her statement under
Patna High Court Cr.Misc. No.31352 of 2017 (2) dt.11-07-2017 2/2 Section 164 Cr.P.C. that she was forcibly abducted, which is false and that no case under Section 366 IPC is not made out against him. It is further submitted that charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence and that the petitioner has no criminal antecedent.
However, learned APP for the State opposes the prayer for bail.
Be that as it may, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas, Sasaram in connection with Sasaram (Darigaon) P.S.
