This is an application for bail in connection with Tajpur P.S.Case No. 46 of 2017 registered for the offences punishable under Sections 341, 323, 307, 427, 387/34 of the Indian Penal Code and 3/4 of Explosive Substance Act. Petitioner is not named in the FIR and it appears that later on he has been named in this case.

It has been submitted on behalf of the petitioner that in two statements of the informant he has not named this petitioner and later on in third statement he has stated that some accused persons, including the petitioner has taken Rs.50,000/- for the safety of the company and they have recommended the petitioner as security guard of the informant and this petitioner used to take

Patna High Court Cr.Misc. No.31200 of 2017 (2) dt.13-07-2017 2/2 commission and except that there is nothing against the petitioner and further allegation is that thereafter co-accused persons started demanding levy from him and he is in custody for two months. Heard learned APP also.

Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail after framing of charge in this case.
