2. In this case, the petitioner is seeking regular bail in connection with Cyber P.S. Case No. 160 of 2024, registered for the offences punishable under Sections 318(4), 319(2), 3(5) of BNS and under Section 66(C)/66(D) of Information Technology Act.

3. As per allegation, the police got an information that some cyber criminals were present in a hotel. The police raided the hotel and two persons, including the petitioner, were arrested while four accused persons became successful in fleeing away. On search from the room of the hotel, 17 withdrawal forms of State Bank of India, account opening forms, 5 ATM cards, and different mobile numbers were recovered from that hotel.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. During investigation, it could not be established that petitioner was involved in cyber crime. The petitioner is under custody since 16.11.2024.

5. On the other hand, the Learned APP for the State, Sri J.N. Thakur, has opposed the prayer for bail.

6. It appears that huge number of ATM cards, account opening forms of SBI, and other incriminating articles were recovered from the room of the hotel, wherefrom the petitioner and another accused person were fleeing away and were intercepted by the police. The petitioner has confessed his guilt.

7. Considering the above-mentioned facts and circumstances, presently, I am not inclined to grant bail to the petitioner. Accordingly, it is rejected.

8. However, the petitioner, if so advised, may renew his prayer for bail after one year.
