The petitioner seeks bail in Kateya P.S. Case No. 307 of 2017 registered for the offence punishable under Sections 366A/34 of the Indian Penal Code.
Informant is the father of the victim girl who in his written complaint dated 16.10.2017 has stated that his minor daughter had gone outside at about 4:00 am in the morning to attend the call of nature when Chandan Yadav abducted her on his motorcycle and fled away. The incident is of 24.08.2017 and thereafter it has been alleged that he talked with the petitioner if her daughter could be brought back but in spite of assurance given by him her daughter has not returned.
It has been submitted by learned counsel for the
Patna High Court Cr.Misc. No.16347 of 2018(3) dt.13-04-2018 2/2 petitioner that the incident is of 24.08.2017 whereas FIR has been registered on 16.10.2017 and there is no allegation against the petitioner that he had kidnapped or abducted the daughter of the informant. It has been further been submitted that there is no allegation made against the petitioner in the FIR by the informant. Petitioner has got no criminal antecedent and is in custody since 14.12.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XV, Gopalganj in connection with Kateya P.S. Case No. 307 of 2017.
