JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-02-2020 After some arguments, the learned counsel for the petitioner seeks liberty to challenge the order dated 21.12.2018 passed by the Certificate Officer-cum-District Supply Officer, Bhagalpur in appeal under Section 60 of Bihar and Orissa Public Demand Recovery Act, 1914 and seeks interim protection till disposal of the appeal.

The learned counsel for the respondents has got no objection.

Having regard to the facts and circumstances of the case, the present writ petition stands disposed of as not pressed,

Patna High Court CWJC No.5751 of 2019(4) dt.25-02-2020 2/2 however, with liberty to the petitioner to file an appropriate appeal and in case an appeal is filed within a period of four weeks from today, the same shall be adjudicated on merits by the Appellate Authority.

It is needless to state that, in case an appeal is filed within a period of four weeks from today, no coercive steps shall be taken against the petitioner till the passing of final orders by the Appellate Authority.

The writ petition stands disposed of on the aforesaid terms.
