The petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 15.09.2020, charges have been framed, not a single witness till date has been examined and the petitioner has antecedent of 14 cases.

Learned counsel for the petitioner submits that allegation in the F.I.R. is of theft of tractor by unknown criminals.

Learned counsel for the petitioner submits that the petitioner has remained in custody for nearly more than one year

Patna High Court CR. MISC. No.14692 of 2022(2) dt.25-04-2022 2/2 seven months when the punishment under the aforesaid Section i.e., 379 of the I.P.C. is 3 years.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 15.09.2020, charges have been framed, not a single witness has been examined till date and the petitioner has served more than half of the sentence, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bikram P.S. Case No. 94 of 2020 with a condition that one of the bailors of the petitioner shall be his father Jagdish Prasad Yadav @ Jagdish Prasad Singh.

In the event, if the learned court below gets an impression that after release on bail, the petitioner is trying to delay the trial then in that event, the learned court below shall forthwith cancel his bail bonds after recording reasons. (Satyavrat Verma, J) Rishi/- U T
