JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner seeks regular bail in connection with Musrigharari P.S. Case No.18 of 2017 (G.R. No.742 of 2017) registered for the alleged offences under Sections 363 and 366-A of the Indian Penal Code.

As per the prosecution case, petitioner along with six other accused persons are said to have kidnapped the minor daughter of the informant, namely, Sujita Kumari. It has been submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. As a matter of fact, the victim had eloped with the son of the petitioner, namely, Mithlesh Kumar Sahni, out of her sweet will and performed marriage with him. She has given

Patna High Court Cr.Misc. No.32524 of 2017 (02) dt.13-07-2017 2/2 information in this regard at Samastipur Police Station vide Annexure-4 of this application. The victim girl has also filed a criminal writ application, bearing Cr. W.J.C. No.1064 of 2017, before this Court seeking protection of her life from her parents. It appears from Annexures-2 and 3 that the victim is major. The Petitioner is a lady and languishing in jail custody since 30.03.2017.

In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-4th, Samastipur in connection with Musrigharari P.S. Case No.18 of 2017 (G.R. No.742 of 2017).
