JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-07-2017 The petitioners seek regular bail in connection with Khaira P.S. Case No. 180 of 2016, registered for offences punishable under Sections 147, 148, 149, 323, 324, 447, 307, 504 of Indian Penal Code.
Allegation against the petitioners is of assault to the wife of informant.
It has been submitted on behalf of the petitioners that there is case and counter case between the parties and petitioners side has also received injuries. Further petitioners have been in judicial custody since25.04.2017.
Learned counsel for the State opposed the prayer for and submitted that the injury caused to the wife of the informant was found to be grievous in nature.

No.31503 of 2017 (2) dt.13-07-2017 2/2 Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, at this stage, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected. However, petitioner may renew his prayer for bail after framing of charge in this case in the court below itself, which will be considered by the court below considering the fact that there is case and counter case between the parties and petitioners side has also received injuries and, thereafter, the court below shall pass an appropriate order, without being prejudiced by the order of this Court (Vinod Kumar Sinha, J) sunil/- U T
