JUSTICE BIRENDRA KUMAR ORAL ORDER 30-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Section 395 of the Indian Penal Code. Some unknown persons allegedly robbed to the informant.

The petitioner has stated on oath that he has got no such type of criminal antecedent. The petitioner is in custody since 28.11.2017. However, he was never put on Test Identification Parade during investigation. Some cash was allegedly recovered from the house of the petitioner, which was personal property of the petitioner and the same was also not put on Test Identification Parade. The recovered mobile was also of the petitioner.

No.9970 of 2018 (3) dt.30-03-2018 P2/ Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Forbesganj (Simraha) P.S. Case No.670 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
