JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-05-2015 Heard learned counsels for the petitioner and the State. The petitioner being the Panchayat Mukhiya is apprehending arrest in a case registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code. It is alleged by the Executive Magistrate of Neemchak Bathani, Gaya that on the basis of complaint made by the beneficiaries of the Indira Awas scheme, the enquiry was conducted and it was found that though accounts of beneficiaries were opened in the Punjab National Bank on the identification of Mukhiya and Panchayat Secretary but withdrawal slip does not contain any identification by the petitioner but the mediator in connivance with officials Punjab National Bank withdrew the money of the beneficiaries and only gave Rs.20,000/- to the respective beneficiaries against withdrawal of
Patna High Court Cr.Misc. No.20674 of 2014 (5) dt.01-05-2015 2/2 Rs.29,000/-.
It is submitted by learned counsel for the petitioner that accusation of withdrawing money is not against this petitioner. The specific accusation is against the middle man Sanju Singh and considering the same the co-accused Satendra Kumar Singh @ Satendra Singh has been granted anticipatory bail by a co-ordinate bench of this court vide Criminal Miscellaneous No. 28137 of 2014.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya in connection with Khizersarai P.S. Case No.126 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
