The present application has been filed for modification of the order dated 12-12-2018 passed in Cr. Misc. No. 74114 of 2018 by which the petitioner was granted anticipatory bail in connection with Khijjarrarai P.S. Case No. 251 of 2018 pending in the court of learned Special Judge, Excise, Gaya.

It is submitted on behalf of the petitioner that in the cause title of the order dated 12-12-2018 passed in Cr. Misc. No. 74114 of 2018, the name of the petitioner has wrongly been mentioned as "Kara Yadav" in place of "Satendra Yadav" and due to that reason, the petitioner could not surrender and furnish bail bond in the court below well within the time. Hence, it is prayed that in the cause title of the order dated 12-12-2018 passed in Cr. Misc. No. 74114 of 2018,

Patna High Court CR. MISC. No.14579 of 2019(2) dt.14-03-2019 2/2 the name of petitioner be corrected as Kara Yadav @ Satendra Yadav and further time may be extended so that the petitioner could surrender and furnish bail bond in the court below. Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, the order dated 12-12-2018 passed in Cr. Misc. No. 74114 of 2018 is modified to the extent that in the cause title, the name of the petitioner be read as Kara Yadav @ Satendra Yadav in place of Kara Yadav and the period of surrender of the petitioner in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions shall remain the same as mentioned in the order dated 09-10-2018 passed in Cr. Misc. No. 62899 of 2018. The order dated 12-12-2018 passed in Cr. Misc. No. 74114 of 2018 is modified to the extent as indicated above. The modification application is, accordingly, disposed of. (Sudhir Singh, J) A.K.V.//- U T
