Petitioner seeks bail in Bhagwan Bazar P.S. Case No. 488 of 2018 registered for the offence punishable under Sections 379 of 411 of the Indian Penal Code. Informant has alleged that while he went inside Chhapra jail after parking his motorcycle to meet his relative suddenly the alarm of motorcycle started sounding and when he came outside he found that petitioner was trying to flee away with his motorcycle and thereafter petitioner was caught and trashed by people assembled there.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. No incriminating material has been recovered from his

Patna High Court CR. MISC. No.16031 of 2019(2) dt.28-03-2019 2/2 possession. He is in custody since 10.11.2018. Considering the fact that petitioner has criminal antecedent of similar nature, I am not inclined to enlarge the petitioner on bail at this stage, hence, the prayer for bail of the petitioner is hereby rejected.

However, it is observed that petitioner may renew his prayer for bail, after completing one year in judicial custody. (S. Kumar, J) manoj/- U T
