JUSTICE PARTHA SARTHY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 24-07-2023 The petitioner is aggrieved with an encroachment on a public road which is agitated in a Public Interest Litigation.
2. A writ petition was disposed off by Annexure-1, wherein a direction was given to the District Magistrate, Samastipur to look into the representation filed at Annexure-1.
3. We see from the counter affidavits filed that a show cause notice was issued, produced as Annexure-C, based on which an encroachment case was also registered as
Patna High Court MJC No.647 of 2020 dt.24-07-2023 2/2 Encroachment Case no. 5 of 2019-20, under the Bihar Public Land Encroachment Act, 1956.
4. The Collector, Samastipur heard the matter and passed order issuing direction to the Circle Officer, Mohiuddinnagar to act in accordance with law and submit a compliance report.
5. The Circle Officer, Mohiuddinnagar has removed encroachment on 22.01.2023 in presence of the writ petitioner and also directed the S.H.O, Mohiuddinnagar Police Station to keep a keen watch on that land so as to not permit any further encroachment.
6. There is no reply to the counter affidavit filed by the respondents.
7. In such circumstance, we deem it appropriate to close the contempt case.
