====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 06-05-2026 Heard Mr. Indrajeet Bhushan, learned counsel for the petitioner and Mr. Bharat Bhushan for the State besides Mr. Devashish Giri representing the informant.

2. The petitioner apprehends his arrest in connection with Uchakagaon P.S. Case No. 366 of 2025 for the offence registered under sections 109, 3(5) of the BNS.

3. As per the prosecution story, the informant alleged that while he was laying in his home, received a gun shot in his back, could see only accused sitting on motorcycle with face hidden, as the family rushed to the place hearing gun shot, the accused left the place. This led to the FIR.

4. In the investigation, one Ranjan Kumar Manjhi was picked up and he narrated the entire story in which the

No.13204 of 2026(3) dt.06-05-2026 2/3 statement is that at the instance of this petitioner, they did the recce of the deceased and once he entered home, it was informed through this petitioner who came along with Israfil and one Afzal Alam. While Afzal Alam stayed with Ranjan Kumar Manjhi, this petitioner along with Shakil went to the injured's place whereafter, he heard the sound of gun shot. They returned and other accused also left the place.

5. Learned counsel for the petitioner submits that neither the informant nor Ranjan Kumar Manjhi have seen the actual occurrence and only because he heard the gun shot, that cannot be the reason to deny the anticipatory bail to the petitioner.

6. In this case, the informant is appearing and Mr. Giri submits that the entire narration of Ranjan Manjhi clearly corroborate the role of this petitioner.

7. Taking into account the submissions of the parties as also the fact that the petitioner has criminal antecedent, in the investigation, his role has cropped up, in that background, this Court is not inclined to extend him the privilege of bail, which is accordingly rejected.

8. However, if the petitioner surrenders within four weeks from today, the Court concerned shall take up the
