In this case, the petitioner is apprehending his arrest in connection with POSCO Civil Lines P.S. Case No. 460 of 2017 registered for offences under sections 354 (1-i) of the Indian Penal Code and Section 12 of the Protection of Children from Sexual Offences Act (POSCO) Act.
An allegation has been made by the Informant that his younger daughter, namely, Shilpi Kumari, used to attend the coaching classes, in the midway, the petitioner used to tease her. Even after soliciting him not to engage himself in such a practice,
Patna High Court Cr.Misc. No.6082 of 2018 (2) dt.02-02-2018 he continued to tease his daughter. He has also made an allegation against the petitioner to have abused his daughter and also assaulted him.
Learned counsel for the petitioner has submitted that there is a counter case from the side of the petitioner wherein allegation has been made to have caused injury upon the petitioner. It has further been submitted that the peace has been restored and both the sides have filed compromise petition. This Court hopes and believes that the petitioner will not involve himself in such incident in future as both the parties have entered into a peaceful settlement.
Looking to the entire facts and circumstances of the case, let the petitioner, namely, Dhirendra Kumar @ Monu @ Dhirendra Kumar Sinha, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, Additional 1st cum Special Jude (POSCO) Act, Gaya in connection with POSCO Case No. 83 of 2017 arising out of Civil P.S. Case No. 460 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
