JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-04-2024 The present writ petition has been filed seeking the following reliefs:- "1. (i) For issuance of an appropriate writ (s), order (s) / direction (s) / for setting aside the order passed by Commandant, Bihar Special armed Police, (hereinafter to be referred as B.S.A.P.) Batallion- 2, Dehri vide Force Order No. 1169/ 2023, corresponding letter No. 288/गो. dated 27.07.2023 by which the petitioner, who was serving as constable in the 'C' company stationed at Adhoura has been terminated from service.

(ii) For issuance of an appropriate

Inspector General of Police, B.S.A.P, Central Range, Patna vide his letter No.5432/ R.O. dated 17.11.2023, corresponding Force Order No. 323 / 2023, by which appeal against the order of termination of the petitioner was rejected.

(ii) For appropriate declaration that the order of termination is nullity in the eye of law as such it never existed or in the alternative.

(iii) For a follow up direction to the respondent authorities to reinstate the petitioner with all consequential benefits."

At the outset, the learned counsel for the petitioner seeks a direction upon the Director General of Police, Bihar, Patna to dispose off the memorial filed by the petitioner on 28.11.2023. 3.

Having regard to the limited prayer made by the petitioner in the present writ petition, I deem it fit and proper to direct the Director General of Police, Bihar, Patna to dispose off the aforesaid memorial filed by the petitioner, by passing a reasoned and a speaking order, in

Patna High Court CWJC No.5003 of 2024(2) dt.04-04-2024 3/3 accordance with law, within a period of six weeks of receipt/production of a copy of this order. 4.

The writ petition stands disposed off on the aforesaid terms.
