JUSTICE SANJAY PRIYA ORAL ORDER 28-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Simri P.S. Case No. 40 of 2017 instituted for the offence under Sections-364(A) and 365 of the Indian Penal Code.

It has been submitted that the demand of ransom was made from the mobile phone of Sajjan Mahto. It has further been submitted that the case has been compromised between the parties and a compromise petition has been filed in the court below. In the written report, it is alleged that wife of one Anil Sahani received call from the mobile to this effect that a sum of Rs. 50,000/- be paid for release of son-in-law of the informant namely, Sakaldeo Sahni, otherwise he will be killed.

Accordingly, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Simri P.S. Case No. 40 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Darbhanga subject to condition that both the bailors should be close relative of the petitioner.
