Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has preferred this application for grant of regular bail in a case registered under Section 341, 323, 385, 307/34 of the Indian Penal Code and under Section 27 of the Arms Act.
Allegation against the petitioner is to attack the informant with knife. The co-accused person, Lav Kush Yadav also demanded rangdari and on refusal he fired at the informant which hit into the stomach of the informant.
Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.15723 of 2022(2) dt.13-07-2022 2/3 the petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The Petitioner has clean antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 29.11.2021. There is general and omnibus allegation against the petitioner. There is specific allegation of firing against the co-accused, namely, Lav Kush Yadav.
Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Nalanda at Bihar Sharif, in connection with Soh Sarai P.S. Case No. 120 of 2021.
The application stands allowed.
