Petitioner is an accused in connection with Raxual Rail P.S. Case No. 55 of 2019 for the offence registered under Section 370 of the Indian Penal Code and Section 79 of the J.J. Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in connection with the present case due to suspicion. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 15.12.2019. It is further submitted that similarly situated coaccused person has been granted bail vide order dated 01.06.2020 passed in Cr. Misc. No. 11048 of 2020.

No.15809 of 2020(6) dt.29-06-2020 2/2 Considering the aforesaid facts and circumstances of the case, the petitioner, named above, is directed to be released on bail in connection with Raxual Rail P.S. Case No. 55 of 2019 to the satisfaction of J.M., Rail, Bettiah, West Champaran, subject to the condition as imposed in the order dated 01.06.2020 passed in Cr.Misc. No. 11048 of 2020 which is quoted here in under :- ".... on furnishing bail bonds of Rs.

25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Raxual Rail P.S. Case No. 55 of 2019, subject to the condition that the petitioner shall render his service as volunteer in the District Health Centre for a period of three months in dedicated Covid Hospital. He is required to report the District Nodal Officer in the concerned region who shall utilise the service of the petitioner appropriately."
