Petitioner seeks bail in connection with Tarari P.S. Case No. 08/17 for offences punishable under Sections 341, 323, 504, 307 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, as lodged by the informant, is that while he was sitting at his door, the petitioner due to old enmity opened fire from his country-made pistol hitting him on the left leg.

It has been submitted by the learned counsel for the petitioner that he is innocent and due to political rivalry and inimical terms the petitioner has been made accused. He submits

No.31363 of 2017 (2) dt.11-07-2017 2/2 that there is no eye-witness to the alleged occurrence and that charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence. It is further submitted that the injury is not on the vital part of the body. However, learned APP for the State opposes the prayer for bail.

Be that as it may, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Tarari P.S. Case No. 08/17, subject to the condition that both the bailors would be a close relative of the petitioner, who would have sufficient immovable property within the jurisdiction of the concerned police station, who will file affidavit stating their relationship with the petitioner.
