Petitioner, already in custody, seeks bail in connection with Rajoun P.S. Case No.140 of 2017, giving rise to S.T. No.551 of 2017, registered under Sections 304(B)/328 of the Indian Penal Code.
Allegation in brief is that within two years of marriage the daughter of the informant was done to death by poisoning as further demand of dowry was not being fulfilled. Learned counsel for the petitioner submits that the wife of the petitioner committed suicide by taking poison as she was under depression for not bearing a child; whereas learned counsel for the State submits that there is no question of any frustration of being issueless as the marriage was solemnized
Patna High Court Cr.Misc. No.18556 of 2018(2) dt.02-04-2018 2/2 only two years prior to the occurrence and there is specific allegation against the petitioner.
Having considered the said facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Rajoun P.S. Case No.140 of 2017, giving rise to S.T. No.551 of 2017, pending in the court of learned Additional Sessions JudgeI, Banka. However, the trial court is directed to expedite the trial and preferably conclude the same within 11⁄2 years.
