In this case, the petitioner is seeking regular bail in connection with Sugauli P.S. Case No. 454 of 2022, registered for the offences punishable under Sections 420, 467, 468/34 of I.P.C.

The informant is a truck owner bearing registration no. BR06GD8478. As per allegation, after affixing his truck number on another truck which was driven by the petitioner, the petitioner along with co-accused Sudhir Singh committed cheating. The informant came to know this fact when a challan came against his truck, and after verification he found that it was the truck of co-accused Sudhir Singh and the petitioner is

The learned counsel for the petitioner has submitted that the petitioner is merely a driver and he is innocent. He is under custody since 22.10.2022.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran, Motihari in connection with Sugauli P.S. Case No. 454 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offense, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
