The petitioner seeks bail in connection with Sherghati P.S. Case no. 677 of 2017 registered under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Act 2016.
648 lts. of country made liquor is said to have been recovered from the Magic Van and its driver namely, Vikky Kumar and petitioner were apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has no concern either with the seized liquor or with the aforesaid vehicle. He happens to be simple
Patna High Court Cr.Misc. No.9191 of 2018(2) dt.17-02-2018 2/2 commuter of the said vehicle and was travelling in it without knowing of keeping the liquor in the said vehicle. He has no criminal antecedent. He has been languishing in custody since 20.11.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Gaya in connection with Sherghati P.S. Case no. 677 of 2017.
