Petitioner seeks regular bail in connection with Karakat (Kachhua) P.S. Case No.90/2003 registered for the alleged offences under Section 25 (1-B) (a), 26 and 35 of the Arms Act.

As per the prosecution case, the petitioner along with other accused persons made firing in front of the gate of the informant and fled away. After search in village they were apprehended and arms and ammunitions were recovered from them.

It has been submitted by learned counsel for the petitioner that earlier the petitioner was enlarged on bail but his bail bond was cancelled on 02.07.2004 as the petitioner had gone

Patna High Court Cr.Misc. No.31022 of 2017 (02) dt.07-07-2017 2/2 out of State in connection with his livelihood and entrusted his advocate to make pairvi in his case but he could not do so. After coming to know about this, the petitioner has surrendered on 18.04.2017 and since then he is languishing in custody. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned S.D.J.M., Bikramganj, at Sasaram (Rohtas) in connection with Karakat (Kachhua) P.S. Case No.90 of 2003, subject to the condition that the petitioner will appear before the learned Court below on each and every date fixed in the case. If he fails to appear on two consecutive dates without any sufficient reason with the satisfaction of the Court, his bail bond shall stand cancelled.
