Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273,414 of the Indian Penal Code and Sections 30(A),38(2),41(1) Bihar Prohibition and Excise Act, 2016.

From the house of the petitioner, huge quantity of liquor was recovered. Petitioner was not there at the time of recovery. Petitioner has stated on oath that he has got no criminal antecedent.

Submission is that the house is in possession of other family members also.

Considering the entire facts, let the petitioner, above named, be released on bail after completion of

Patna High Court CR. MISC. No.12036 of 2020(2) dt.28-02-2020 2/2 investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sonbarsa Police Station Case No.164 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
