JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-12-2018 After some argument, the learned counsel for the petitioner seeks liberty to file a fresh objection under Section 9 of the Bihar & Orissa Public Demand Recovery Act, 1914 so that the Certificate Officer can appreciate the issue involved in the present case judiciously and in its proper perspective and till then the petitioner seeks some protection.

Accordingly, the present writ petition is disposed of as withdrawn with liberty to the petitioner to approach the Certificate Officer, Supaul in connection with Certificate Case

Patna High Court CWJC No.14710 of 2016(2) dt.05-12-2018 2/2 No. 59 of 2014-15 and file an objection within a period of four weeks from today which shall be considered judiciously and in its proper perspective by the Certificate Officer, Supaul and a final order would be passed under Section 10 of the Bihar & Orissa Public Demand Recovery Act, 1914.

Till the final order is passed, no coercive steps shall be taken against the petitioner herein.

However, it is made clear that in case no fresh objection is filed within a period of four weeks from today, the Certificate Officer shall proceed ex parte.
