This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Pirbahore PS Case No. 658 of 2018 for the alleged offence punishable under Section 414/34 of the Indian Penal Code. Learned counsel for the petitioner would submit that the motor cycle was intercepted and Rahul Kumar and Sahrukh were arrested by the police. On the basis of the confessional statement of the above named co-accused, petitioner was apprehended in this case. He was remanded to judicial custody on 16.11.2018.

Considering the fact that petitioner has remained in

Patna High Court CR. MISC. No.13629 of 2019(2) dt.06-03-2019 2/2 custody for more than three months, nothing was recovered from conscious possession of the petitioner and his name surfaced on the confessional statements of the co-accused, this application is allowed.

Accordingly, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Pirbahor PS Case No. 658 of 2018.
