Heard Mr. Krishna Prasad Singh, learned senior counsel for the petitioner as well as learned Additional Public Prosecutor for the State.

Petitioner seeks bail in a case registered in connection with Mansi P.S. Case No. 295 of 2021 for the offences punishable under Sections 171, 419, 420, 467 and 468 of the Indian Penal Code.

The prosecution case in nutshell is that the petitioner by manipulating the documents obtained an appointment letter for the post of Sub-Inspector, in fraudulent manner.

No.14133 of 2022(3) dt.12-10-2022 2/3 Learned senior counsel for the petitioner submits that the entire case is based on documentary evidences and now the investigation of the crime has already been completed and the charge sheet has been submitted and the accusation/ charges are is required to be adjudicated during the course of trial. He further submits that the petitioner was an aspirant of Sub-Inspector, however, on the allurement made by some brokers, he had accepted the selection letter though there was no connivance of the petitioner with the broker, who has committed all such fraudulent activity. He last submits that the petitioner is in custody since 03.11.2021, having fair antecedent.

On the other hand, learned counsel for the State opposed the bail application and submits that fraudulent activity of the petitioner has transpired during the course of investigation, and he was also found indulged in such type of practices at different places for different examination. Regard being had to the submission made on behalf of the parties and considering the fact that investigation of the crime is already completed, which is mostly based on documentary evidences and he is in

No.14133 of 2022(3) dt.12-10-2022 3/3 custody since 03.11.2021, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional chief Judicial Magistrate-IV, Khagaria in connection with Mansi P.S.Case No. 295 of 2021 subject to the condition that one of the bailors will be the close relatives of the petitioner with further conditions which are as follows:- (i) The petitioner will cooperate in conclusion of the trial.

(ii) He will remain present on each and every date of trial till disposal of the case.

(iii) He will not try to tamper with the evidence or intimidate the witnesses to delay the disposal of trial. (iv) In the event of default of two consecutive dates without any cogent reason, his bail bonds will liable to be cancelled.
