The petitioner seeks bail in connection with Taraiya P.S. Case No.11/2017 registered under Sections 272 273/34 of Indian Penal Code and Sections 30(a), 38, 41 of Bihar Prohibition and Excise Act, 2016.

800 liters of country made liquor is said to have been recovered from the Bathan of Narayan Mahto and 400 liters of country made liquor is said to have been recovered in front of the house of Ram Jharan Rai. Co-accused namely Lallan Rai and petitioner are said to have brought the said liquor. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case No

Patna High Court Cr.Misc. No.7106 of 2018 (2) dt.12-02-2018 2/2 incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner was not apprehended on the spot. He has no concern with the seized liquor. He has been languishing in custody since 09.12.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, Saran at Chapra, in connection with Taraiya P.S. Case No.11/2017.
