Petitioner is apprehending arrest in connection with Sanhaulla P.S. Case No. 164 of 2019 for the offence under sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In the instant case total 432 liters of liquor was seized from the pick up van.

Learned counsel for the petitioner submits that name of the petitioner surfaced in the instant case on the disclosure made by Tuntun Choudhary.

Patna High Court CR. MISC. No.12000 of 2020(2) dt.05-03-2020 2/2 from the pick up van which does not belong to the petitioner. Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 2nd cum Special Judge, Excise, Act, Bhagalpur, in connection with Sanhaulla P.S. Case No. 164 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C.

In the event, the petitioner is found involved in similar activities in future, the court below shall be at liberty to cancel the bail bonds of the petitioner.
