JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-07-2017 The petitioner seeks regular bail in connection with Jandaha P.S. Case No. 56 of 2017, registered for offences punishable under Sections 302, 326 and 34 of the Indian Penal Code.

Allegation against the petitioner and other co-accused persons is of assault to the deceased causing his death. It has been submitted on behalf of the petitioner that F.I.R itself shows that she is an old lady aged about 60 years. Further no specific allegation has been attributed to her and whole family members have been made accused in this case. She has been in judicial custody for last three months. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and also considering the fact that petitioner is a lady aged about sixty years, as such, let the petitioner above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.31648 of 2017 (2) dt.13-07-2017 2/2 bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Jandaha P.S. Case No. 56 of 2017,subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of her bail bonds.
