JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-10-2022 The present writ petition has been filed for directing the respondent no. 3 i.e. the Additional District Magistrate-cumAdditional Collector, Gopalganj to expeditiously dispose off the pending appeal bearing Miscellaneous Appeal no. 3 of 2018-19, preferred by the private respondent no. 7.

The learned counsel for the respondent- State submits that in case, any appeal is pending, it is incumbent upon the

Patna High Court CWJC No.4007 of 2022(2) dt.13-10-2022 2/2 respondent- authorities to consider the same in accordance with law and dispose of the same, hence, the respondent no. 3 shall definitely dispose of the aforesaid pending appeal, within a stipulated time frame.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to dispose off the present writ petition with a direction to the respondent no. 3 to dispose off the pending appeal, within a period of 12 weeks of receipt/ production of a copy of this order, by passing a reasoned and a speaking order, in accordance with law, after hearing the appellant and the affected parties.
